About Heritage Hauling Terms and Conditions
These Terms & Conditions govern the use of the Heritage Hauling & Land Services LLC website and the services we provide. By requesting a quote, scheduling services, or otherwise engaging Heritage Hauling & Land Services LLC, you agree to the terms applicable to the services requested.
Quotes and Scope of Work
Quotes are based on the information available at the time of the estimate, including descriptions, photographs, site conditions, and/or an on-site assessment. The quoted price applies to the scope of work discussed and agreed upon.
If the amount or type of material, access conditions, labor requirements, disposal needs, concealed or undisclosed items, or other circumstances differ from what was originally described or observed, Heritage Hauling & Land Services LLC may revise the price before performing the additional work.
Any additional work requested by the customer may result in additional charges. Heritage Hauling & Land Services LLC will communicate any additional charges before performing the additional work.
Prohibited & Hazardous Materials
Heritage Hauling & Land Services LLC does not accept or transport hazardous, regulated, or otherwise prohibited materials, including but not limited to paint, chemicals, fuels, oils, pesticides, certain batteries, compressed-gas cylinders, fire extinguishers, asbestos-containing materials, biohazardous or medical waste, and other materials requiring specialized handling or disposal.
Customers are responsible for identifying and disclosing any known hazardous or prohibited materials before work begins. Prohibited materials discovered beneath, behind, inside, or mixed within other items will be left at the property and are not included in the removal service.
Only the items, materials, or areas specifically identified and agreed upon as part of the scope of work are included in the quote. The presence of additional hazardous or prohibited materials near, beside, underneath, or within the quoted materials does not automatically include those items in the quoted scope of work.
Removal, Ownership & Disposal
By authorizing Heritage Hauling & Land Services LLC to remove items from a property, the customer represents that they own the items or have the authority to authorize their removal.
Once authorized items have been removed from the property and Heritage Hauling & Land Services LLC has departed the service location, the removed items are considered surrendered to Heritage Hauling & Land Services LLC. Heritage may dispose of, recycle, donate, salvage, reuse, or otherwise handle the removed items at its discretion, subject to applicable law.
Customers are responsible for identifying and removing any personal belongings, valuables, documents, or other items they wish to keep before removal begins. Heritage Hauling & Land Services LLC is not responsible for retrieving or returning items after they have been removed from the property and the crew has departed.
Customer Authorization & Property
The customer represents that they have the legal right or proper authorization to request services at the property and to authorize Heritage Hauling & Land Services LLC to enter the property and perform the agreed-upon work.
For eviction, foreclosure, estate, probate, abandoned-property or property-management cleanouts, the customer represents that all legally required notices, possession proceedings, approvals and authorizations have been completed before Heritage begins work.
The customer is responsible for obtaining any necessary permissions from property owners, landlords, property managers, tenants, occupants, homeowners associations, or other parties before work begins.
Heritage Hauling & Land Services LLC may rely on the authorization provided by the customer and is not responsible for ownership disputes or claims involving property or items the customer authorized Heritage to remove.
Payment & Charges
Payment terms will be provided with the applicable quote, invoice, or service agreement. Customers are responsible for paying all charges for services performed in accordance with the agreed-upon scope of work.
The final amount may differ from the original quote when the customer requests or approves additional work, additional material is authorized for removal, or other agreed changes are made to the original scope of work. Any applicable disposal fees, special handling fees, or other charges will be communicated when they apply.
Commercial customers may be provided separate invoicing or payment terms as agreed upon with Heritage Hauling & Land Services LLC.
Property Access & Site Conditions
The customer is responsible for providing safe and reasonable access to the areas where services are to be performed, including access through gates, doors, elevators, loading areas, parking areas, and other portions of the property necessary to complete the agreed-upon work.
Heritage Hauling & Land Services LLC is not responsible for delays or inability to complete work caused by restricted access, locked areas, unavailable elevators, blocked loading areas, unsafe conditions, or other circumstances outside of our reasonable control.
If conditions at the property present a safety hazard or prevent the work from being performed safely, Heritage Hauling & Land Services LLC reserves the right to stop, postpone, or decline the affected work until the condition is corrected.
Damage & Property Protection
Heritage Hauling & Land Services LLC will use reasonable care while performing services and will take reasonable precautions to protect the customer’s property.
Customers are responsible for identifying and notifying Heritage of fragile surfaces, concealed utilities, underground lines, septic systems, irrigation systems, restricted areas, or other property conditions that may not be readily visible or apparent before work begins.
Heritage Hauling & Land Services LLC is not responsible for pre-existing damage, normal wear and tear, or damage resulting from concealed, undisclosed, or unsafe property conditions that could not reasonably have been identified before the work was performed.
Scheduling, Cancellations & Delays
Scheduled service dates and arrival times are estimates and may be affected by traffic, weather, disposal facility conditions, equipment issues, job-site conditions, or other circumstances outside of Heritage Hauling & Land Services LLC’s reasonable control.
Customers should provide reasonable notice if they need to cancel or reschedule a service. Any cancellation fee, trip charge, deposit requirement, or other applicable charge will be communicated to the customer before it applies.
Heritage Hauling & Land Services LLC reserves the right to reschedule, postpone, or discontinue work when weather, unsafe conditions, restricted access, equipment limitations, or other circumstances make it unsafe or impractical to perform the work.
Service Limitation & Right to Refuse Work
Heritage Hauling & Land Services LLC reserves the right to decline, stop, or discontinue any service that is outside the agreed scope of work, beyond the capabilities of our personnel or equipment, prohibited by law or disposal requirements, or that we reasonably determine cannot be performed safely.
We may also decline work involving conditions or materials that present an unreasonable risk to our employees, subcontractors, customers, the public, property, vehicles, or equipment.
Any work not specifically included in the agreed-upon scope is not considered part of the service unless separately authorized by Heritage Hauling & Land Services LLC.
Subcontractors & Third-Party Services
Heritage Hauling & Land Services LLC may, when appropriate, use or coordinate qualified subcontractors or third-party service providers to assist with portions of a project.
Certain work requiring specialized licensing, certification, equipment, or expertise may be performed by a properly qualified third party rather than directly by Heritage Hauling & Land Services LLC.
Any third-party work coordinated through Heritage Hauling & Land Services LLC that results in additional charges will be communicated to the customer before that additional work is authorized.
Weight, Load & Equipment Limits
All hauling and removal services are subject to the safe and legal operating limits of Heritage Hauling & Land Services LLC’s vehicles, trailers, equipment, and personnel.
Heritage Hauling & Land Services LLC will not knowingly overload a vehicle or trailer or transport a load that we determine cannot be safely or legally transported.
Heavy materials, unusually dense loads, oversized items, or materials requiring special equipment or handling may be subject to separate pricing or may be declined. Any applicable additional charges will be communicated before the additional work is performed.
Customer Responsibilities
Customers are responsible for providing accurate and complete information regarding the requested services, the materials or items to be removed, site conditions, access requirements, and any known hazards or restrictions that may affect the work.
Customers are responsible for clearly identifying which items are to be removed and which items are to remain at the property. Items not specifically identified or included in the agreed-upon scope of work are not considered part of the service.
Before work begins, customers should remove or secure cash, jewelry, important documents, medications, firearms, personal records, sentimental items, and other valuables they wish to retain.
The customer is responsible for ensuring that children, pets, tenants, occupants, visitors, and other individuals remain reasonably clear of active work areas while services are being performed.
Customers must disclose any known conditions that could affect the safe or lawful performance of the work, including hazardous materials, restricted access, fragile surfaces, concealed utilities, or other unusual property conditions.
Completion of Service & Customer Acceptance
Heritage Hauling & Land Services LLC will perform the services described in the agreed-upon scope of work. Upon completion, customers are encouraged to inspect the work area when reasonably possible and notify Heritage Hauling & Land Services LLC of any concerns regarding the services performed.
Once Heritage Hauling & Land Services LLC has completed the agreed-upon work and departed the service location, the service will be considered completed unless otherwise stated in writing.
Requests for additional removal, cleanup, hauling, demolition, or other work that was not included in the original agreed-upon scope will be considered additional work and may require a separate quote or additional charge.
Nothing in this section changes the provisions regarding removed property. Items authorized for removal and taken from the property are considered surrendered to Heritage Hauling & Land Services LLC once Heritage has departed the service location, as described elsewhere in these Terms & Conditions.
Limitation of Liability
To the extent permitted by applicable law, Heritage Hauling & Land Services LLC will not be responsible for indirect, incidental, special, or consequential losses arising from the performance or inability to perform services.
Heritage Hauling & Land Services LLC is not responsible for loss or damage resulting from pre-existing conditions, concealed or undisclosed property conditions, inaccurate information provided by the customer, unauthorized items placed within materials designated for removal, or circumstances outside Heritage’s reasonable control.
Nothing in these Terms & Conditions is intended to exclude or limit any responsibility or liability that cannot legally be excluded or limited under applicable law.
Governing Law & Contact Information
These Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any rights or remedies available under applicable federal, state, or local law remain subject to those laws.
